Agreement between User and www.vibranthypnotherapy.com
Welcome to www.vibranthypnotherapy.com. The www.vibranthypnotherapy.com website (the “Site”) is comprised of various web pages operated by Marta Kova Vibrant Hypnotherapy LLC. www.vibranthypnotherapy.com is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the “Terms”). Your use of www.vibranthypnotherapy.com constitutes your agreement to all such Terms. Please read these terms carefully, and keep a copy of them for your reference.
www.vibranthypnotherapy.com is a Hypnotherapy, Hypnosis, NLP Coaching, Tarot Reading Services Site.
The purpose of the website is to provide information about Marta Kova Vibrant Hypnotherapy LLC services.
Privacy
Your use of www.vibranthypnotherapy.com is subject to Marta Kova Vibrant Hypnotherapy LLC’s Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.
Electronic Communications
Visiting www.vibranthypnotherapy.com or sending emails to Marta Kova Vibrant Hypnotherapy LLC constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing.
Children Under Thirteen
Marta Kova Vibrant Hypnotherapy LLC does not knowingly collect, either online or offline, personal information from persons under the age of thirteen. If you are under 18, you may use www.vibranthypnotherapy.com only with permission of a parent or guardian.
Cancellation/Refund Policy
Our appointments are very important. Please follow:
* 24h notice if you need to cancel or reschedule your appointment.
* Less than 24h notice will result in charge $45 Cancellation Fee (Hypnotherapy/Coaching Session) and $25 (Readings)
* All “No-Shows” will result in charge 100% of the scheduled service/session.
* Late arrivals up to 15 minutes will be accepted. I will do everything I can to accommodate late arrival, however,
Client understands that it will limit our time allocated for the session.
* Late arrivals above 15 minutes will be considered as “No Show” and will result in charge 100% of the
scheduled service/session.
To avoid Late Arrivals Client is advised to check Internet connection, camera set up, microphone, and other technical details at least 10 minutes prior scheduled appointment.
* Membership Program: Client can cancel the monthly or annual membership at any time.
*Annual Membership “Mind Mastery Complete” includes 4 individual annual sessions, 1 per quarter (3 months). Unused sessions expire within 12 months.
REFUNDS
Due to nature of the services No Refunds will be issued unless:
* Client cancel the appointment at least 24h before the set time
* Client cancel participation in Individual or Group Program including, but not limited to, Membership Program, Weight Loss Program, at least 24h before the first session
* Client purchased a package of sessions (1:1 Package Sessions or Group Sessions Program) and completed 1st
(first) session and wish to no longer continue the services. Client will be charged full price for that session but will receive 100% refund for the remaining sessions. Client must send a written notice that he/she does not wish to continue with the services within 24h after the 1st (first) session. No refunds will be issue after that time or after completed 2nd, 3rd, and so on, sessions.
* No Refunds will be issued after purchase a digital product including, but not limited to, courses, guides, pre-recorded hypnosis sessions, etc.
* Hypnotherapist reserves the right to refuse treatment to anyone at any time. In that case, Client will
receive 100% refund of the remaining unused sessions.

Recording and Use of Group Hypnotherapy / Coaching Sessions
1. Consent to Record: By participating in the group hypnotherapy coaching sessions, You agree and consent to the recording of audio, video, and any other forms of communication during the sessions.
2. Use of Recordings: The recordings may be used by the Marta Kova Vibrant Hypnotherapy (“the Company”) for various purposes, including but not limited to:
- Advertising and marketing materials
- Sale or distribution as part of educational products or services
- Online courses and webinars
You agree that the Company may edit, adapt, and distribute the recordings without further consent or compensation.
4. Release of Rights: You grant the Company an irrevocable, perpetual, worldwide, royalty-free license to use, reproduce, distribute, and display the recordings, including any portions of the Your contributions. You waive any right to inspect or approve the finished product or the use to which it may be applied.
5. Withdrawal of Consent: If at any point You wish to withdraw their consent to be recorded, you must notify the Company in writing. However, recordings made prior to the withdrawal of consent may still be used by the Company as described in this agreement.
6. No Compensation: You acknowledge that they will not receive any compensation for the use of the recordings in which they appear.
DISCLAIMER
The purpose of a program of hypnotherapy is for vocational and avocational self-improvement (Business and Professions Code 2908) and as alternative or complementary treatment to healing arts services licensed by the state. A hypnotherapist is not a licensed physician or psychologist, and hypnotherapy services are not licensed by the State of California. Services are non-diagnostic and do not include the practice of medicine, neither should they be considered as a substitute for licensed medical or psychological services or procedures.
If you are under the care of licensed mental health professional and/or taking any medications, you understand and agree to consult with your Doctor prior undergoing Hypnosis. That includes participating in 1:1 sessions, group sessions, online courses, or programs. Hypnosis is not suitable for people suffering from following disorders, including but not limited to: psychosis, schizophrenia, epilepsy, severe depression, drug or alcohol addiction, chronic pain that has not been diagnosed by a licensed health care professional, and others.
Hypnotherapists who assist clients with weight loss and/or other health and fitness goals may provide general nutritional advice and/or recommend published books, food guides and health and fitness publications. This is not a substitute for medical advice, and you are advised to seek your Doctor’s approval before making any medical/health/lifestyle changes.
During the session Hypnotherapist/Hypnotist may use variety of modalities including but not limited to: guided imagery, NLP (neurolinguistic programing), EFT (Emotional Freedom Technique). Energy modalities such as EFT: may be used in conjunction with hypnotherapy. EFT works with body’s energy system through tapping with the fingertips at end-points of the body’s energy meridians to release blockage that cause negative emotions.
Services consist of a program of conditioning, including an undetermined number of private sessions, group session, online videos/courses/programs, depending on the client’s individual needs. The hypnotist will to the best of his or her ability endeavor to accomplish the objectives of the client’s sessions. While hypnosis may be an effective technique for many purposes, the effectiveness may vary from individual to individual, and no specific results or progress can be promised or guaranteed.
The feelings and experiences one has in the hypnotic state can vary from individual to individual. Many people remain completely aware of everything that is going on while in hypnosis. Some individuals experience a hyper-awareness where sensations are perceived enriched and vivid. The ability to visualize or imagine is often enhanced. A feeling of deep relaxation is common, and some people describe the hypnotic state as an escape from physical tension and emotional stress, while remaining completely alert.
The use of hypnosis could elicit memories of past events which may or may not be literally true. It is possible that events under hypnosis will be distorted or misconstrued. Memories or images evoked under hypnosis are not necessarily accurate and may be a construction or a composite of memories. Without corroborating information, it is not possible to determine whether a specific memory is true or false, even if it seems true to the client.
While it is the practice of Hypnotherapists to keep information confidential, information revealed in hypnotherapy is not subject to the psychotherapist-patient privilege. A court may order disclosure of information learned in therapy.

The site may contain testimonials. These are personal opinions and experiences and have not been clinically evaluated or proven. Your results may vary.

International Users
The Service is controlled, operated and administered by Marta Kova Vibrant Hypnotherapy LLC from our offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. Indemnification
You agree to indemnify, defend and hold harmless Marta Kova Vibrant Hypnotherapy LLC, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney’s fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. Marta Kova Vibrant Hypnotherapy LLC reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with Marta Kova Vibrant Hypnotherapy LLC in asserting any available defenses.
Arbitration
In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms and Conditions, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in a location mutually agreed upon by the parties. The arbitrator’s award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney’s fees. The parties agree to arbitrate all disputes and claims in regards to these Terms and Conditions or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly, including Tort claims that are a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions.
Class Action Waiver
Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH’S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/ OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and Marta Kova Vibrant Hypnotherapy LLC agree otherwise, the arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of a representative or class proceeding.

THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. MARTA KOVA VIBRANT HYPNOTHERAPY LLC AND/OR ITS SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE SITE AT ANY TIME.

Termination/Access Restriction
Marta Kova Vibrant Hypnotherapy LLC reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of California and you hereby consent to the exclusive jurisdiction and venue of courts in California in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.
You agree that no joint venture, partnership, employment, or agency relationship exists between you and Marta Kova Vibrant Hypnotherapy LLC as a result of this agreement or use of the Site. Marta Kova Vibrant Hypnotherapy LLC’s performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Marta Kova Vibrant Hypnotherapy LLC’s right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by Marta Kova Vibrant Hypnotherapy LLC with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Marta Kova Vibrant Hypnotherapy LLC with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Marta Kova Vibrant Hypnotherapy LLC with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.
Changes to Terms
Marta Kova Vibrant Hypnotherapy LLC reserves the right, in its sole discretion, to change the Terms under which www.vibranthypnotherapy.com is offered. The most current version of the Terms will supersede all previous versions. Marta Kova Vibrant Hypnotherapy LLC encourages you to periodically review the Terms to stay informed of our updates.
